Section 1.The Employers recognize the Union as the exclusive representative for purposes of collective bargaining of all full-time and regular part-time taxicab drivers employed by the Employers in accordance with the certification issued by the National Labor Relations Board in Cases 28-RC-4659 and 28-RC-466l.
Section 2.Whenever the words “driver” or “drivers” are used in this Agreement, they designate only such drivers as are covered by this Agreement.
Section 3.The recognition of the Union as the exclusive representative for drivers in this unit applies to drivers known as taxicab drivers and not any other employees of the Employers.

Nothing in this Agreement shall preclude the Employers, to the extent permitted by law, from sub-contracting with individuals to provide taxicab service as independent contractors, or from using any other arrangements, including arrangements known generally in the taxicab industry as “leasing”. If the Employers do decide to sub-contract with individuals or use any other arrangements, including “leasing”, the Employers agree to offer such contracts or leases to their existing drivers prior to other individuals. If the Employers do make such an offer to the existing drivers, said offers shall be on the basis of seniority, starting with the most senior within that company, provided the driver qualifies under the terms established by the Employer(s). If a driver qualifies, he shall have not less than thirty (30) days to make final arrangements.
Section 4.Nothing herein shall prohibit the Employers from selling medallions to independent contractors or to owner-operators to the extent permitted by law provided existing drivers of the affected Employer(s) who meet the qualifications established by the affected Employer(s) shall be given rights of first refusal in order of seniority. The driver shall have not less than thirty (30) days to make final arrangements.
Section 5.Whenever in this Agreement employees are referred to in the male gender, it is agreed such reference applies to female employees as well as male employees.
Section 6.The parties hereby acknowledge that ABC Union Cab Company, Inc., Ace Cab, Inc., Vegas-Western Cab, Inc., and A-N.L.V. Cab Company are four (4) independent and separate legal entities which have negotiated collectively with the Union solely for the purpose of entering into this collective bargaining agreement.
