Section 1. The Employers will provide one (1) enclosed bulletin board in the Drivers’ Room for use by the Union solely for the purpose of noticing meetings of the United Steelworkers Union or other Union activities.
Section 2. All bulletins or notices which the Union intends to post on the bulletin board must be submitted to the General Manager of the Employers, or his designee, for the Employers’ approval prior to posting. The Union agrees it will not post any derogatory or inflammatory material or any material which adversely affects the interests of any Employer covered by this Agreement. The Employers’ approval regarding posting shall not be unreasonably withheld.
Section 3. A representative of the Union shall maintain the Union bulletin board in a neat and orderly fashion.
Section 1. The Employers, at their discretion, may continue to discipline and/or discharge drivers for low book in accordance with the provisions of this Article.
Section 2.
(a) The net book of a driver is low, for the purposes of this Article, if it is 15% or more below the average net book of all drivers working the same shift on the same day in the same Company as that driver, subject to the provisions of Section 3 below.
(b) If a driver’s overall net book is low for any period of time designated by the Employer (in no event shall that period be less than two (2) calendar weeks, but it may be longer), the driver may be disciplined up to and including discharge.
(c) None of the provisions of this Article shall restrict the right of the Employer to discipline any driver, up to and including discharge, for a daily low book which is at least 50% below the average net book for the same shift, day and Company, for not being at work in his cab when he is on duty, or for any other reason permitted under the terms of this Agreement.
Section 3. In detennining the average net book for a shift within a Company, that Employer shall exclude from its calculations of average net book
(a) the net book of those drivers on that shift who have a mechanical breakdown lasting in excess of one (1) hour during the hours of that shift,
(b) the net book of a driver who is required to drive more than one (1) cab during the hours of the shift, and/or
(c) the net book of both drivers when a driver relieves another driver who began the shift but did not complete the shift.
Section 4. For the purpose of this provision, the net book is the gross book reflected on the driver’s trip sheet for the shift minus all trip charges deducted from the totalbook in accordance with Section 2 of Article 34. The average net book would be calculated before the deduction of any shift charge, trip charge or gas charge is deducted in accordance with Section 1 of Article 34.
Section 5. The Employer will post, after such information is available and complete, the average net book by shift and by Employer as well as the actual net book for the drivers who worked that shift for that Employer. The identity of the drivers whose actual net books are shown need not be revealed. However, the Employer, at its discretion, may post the name and/or the employee number of the drivers.
