ARTICLE 2- UNION DUES CHECK-OFF

Section 1.During the term of this Agreement, the Employers will check-off dues and initiation fees, each as designated by the International Secretary-Treasurer of the Union, as membership dues in the union on the basis of and for the terms of individually signed voluntary check-off authorization forms agreed to by the parties, heretofore or hereafter submitted to the Employers. The Employers shall promptly remit any and all amounts so deducted to the International Secretary-Treasurer of the Union in the manner designated by the Union in writing. and shall furnish a list with the deposit of the employees from whom the deductions were checked off and the amount thereof. A copy of such list will be sent to the Local Union.

Section 2.The following general conditions will be applicable:

(a) New check-off authorization forms will be submitted to the Employers through the Local Union.

(b) Dues are owed for a given month during which an employee shall have or received pay for five shifts or more and shall be deducted from the pay received in the first pay period in the succeeding month. Not more than two succeeding months’ dues, if owed, will be withheld at any one time.

 

(c) Deductions on the basis of authorization cards submitted to the Employers shall commence with respect to dues for the month in which the Employers received such authorization cards, regardless of the date on such form.

(d) Unless the Employer is otherwise notified, the only Union membership dues to be deducted for payment to the Union from the pay of the employee who has furnished an authorization shall be the monthly Union dues. When notified by notation on the list referred to in “a” above, the Employers will also deduct standard initiation fees.

(e) The obligation of the Employers to deduct monthly dues and/or standard initiation fees from the pay of any employee for the first pay period in the succeeding month shall be conditioned on that employee having sufficient net earnings for that pay period after all other deductions are made from that employee’s gross earnings for that pay period, including, but not limited to, withholding taxes, F.I.C.A., shortages, garnishment and attachments.

Section 3.Indemnity The Union shall indemnify the Employer and hold it harmless against all suits, claims, demands, and liabilities that shall arise Out of or by reason of any action that shall be taken by the Employer for the purpose of complying with the foregoing provisions of this Article.
