ARTICLE 27- NONBARGAINING UNIT EMPLOYEES
Section 1. Nonbargaining unit employees will not be assigned to work as drivers to any greater extent than they have in the past. Notwithstanding the prior provision, periodic use of dispatchers and/or supervisors to drive a taxicab shall not be a violation of this Agreement.
Section 2. Any individual employed by the Employer as a dispatcher or as a supervisor as of the effective date of this Agreement who, at that time, holds seniority as a driver shall retain his seniority for the term of the Agreement.
Section 3. No supervisor or dispatcher may displace a driver on his bid shift during a bid period.
Section 1. Union stewards shall be designated by the Union. Such designation shall be made by certified letter sent by the International Union Staff Representative to the General Manager of the Employers.
Section 2. The Union may only designate a maximum of one (1) regular steward per Employer per shift (day/night). The Union may designate one (1) alternate steward for each regular steward designated with the understanding that the alternate steward shall have no authority to function as a steward unless the regular steward is off duty on the day in question.
Section 3. The union stewards’ functions and responsibilities are as follows:
(a) To report to the International Union Staff Representative and to the designated representative of the Employer alleged infractions of this Agreement. He is not to report such matters to any other party.
(b) To represent the Union and the unit employees of his Employer on his shift in a proper and professional manner at all times.
(c) Process grievances during nonwork time.
(d) Attend prescheduled meetings with representatives of the Employer.
The union steward shall not:
(a) Stop or interfere with the work of any employee of the Employers or stop, interfere with or disrupt the operations of the Employers at any time. Infraction of this rule shall be cause for immediate dismissal of the union steward. This shall not preclude a steward talking to employees in a manner that does not stop, disrupt or interfere with operations of the Employers.
Section 4. The union steward shall be a working employee of his Employer and is subject to all the same rules and regulations applicable to all other drivers of the Employer. He is responsible to work his assigned shifts like any other driver.Section 5. The Employers will grant a union steward unpaid time off from work to attend a prescheduled meeting set by the Employer and the Union during the steward’s work shift to discuss a grievance and/or a problem involving the Employer and shift for whom he works, The Union and the Employer will make a reasonable effort to schedule such meetings at a time which does not conflict with the steward’s shift.
