ARTICLE 35-NO STRIKES-NO LOCKOUTS
Section 1. Both the Union and the Employers recognize the service nature of the taxicab industry and the duty of the Employer to render Continuous and gracious service to the public in accordance with applicable laws and rules and regulations and in accordance with the certificates of the Employers. The Union, therefore, agrees it will not call, engage in, encourage and/or sanction any strike, sympathy strike, work stoppage, slowdown, picketing, sit-down, sit-in, boycott or any other interference with the conduct of the Employer’s business for any reason whatsoever This shall include dealings by the Employers with suppliers, deliverymen, organizations or other employees not covered by this Agreement.
Section 2. The Employers agree that they will not lock out their employees covered by this Agreement.
Section 3. It is understood and agreed that neither the Union collectively, nor any employees individually, may honor any picket line during the term of this Agreement. This shall include any picket line established at any hotel/casino m Southern Nevada.
Section 4. In the event any employee violates any provision of this Article, the Union and its union stewards shall have an affirmative responsibility to seek the return to work of the violators The Employer may discipline or discharge any employee who violates any provision of this Article, In the event a union steward violates any provision of this Article, an Employer may assess a greater disciplinary penalty against such union stewards than assessed against other employees of that Employer who violate this Article. If the Union, or any representative of the Union, including stewards, fails to exercise an honest affirmative responsibility to seek the return to work of violators; or if the Union, or any representative of the Union, including stewards, in any manner, condones, authorizes, sanctions, supports, encourages, causes or participates in any violation of this Article, the Union shall be liable for damages, including any punitive damages awarded by a court or a jury If the Union and its representatives, including stewards, exercise an honest affirmative responsibility to seek the return to work of violators, publicly declares the strike illegal, and the Union and/or its representatives, including stewards, do not, in any manner, condone, authorize, sanction, support, encourage, cause or participate in any violation of this Article, the Union will not be liable for damages resulting from such violation.
Section 5. Except for actions taken against an employee, any violation of the provisions of this Article shall not be subject to the provisions of Article 15 — Grievance and Arbitration Procedure.
