Section 1. When new or additional employees are needed, each Employer shall have the sole discretion of selecting which applicant shall be employed. The Employer shall have the right to reject any applicant for employment.
Section 2. When a new employee is being hired by either ABC Union Cab Company, Inc., Ace Cab, Inc., or by Vegas-Western Cab, Inc., consideration will be given to current taxicab drivers of A-N.L.V. Cab Company and to non-bid extra board drivers. However, this provision shall not be construed as limiting the discretion of each Employer in selection of applicants for hire.
ARTICLE 5-PROBATIONARY PERIOD AND SENIORITY
Section 1. Every employee shall be a probationary employee until he has completed one hundred and twenty (120) full shifts since his last date of hire with his individual Employer.
Section 2. For time worked on and after the effective date of this Agreement, full shifts worked in the employment of one (1) Employer covered by this Agreement shall be credited toward the probationary period with any other Employers covered by this Agreement.
Section 3. Upon the successful completion of his probationary period, an employee shall become a regular employee of his Employer and the employee’s seniority shall date back to his last date of hire with this current Employer.
USE OF SENIORITY: Length of seniority shall be considered only as specifically provided in this Agreement.
TERMINATION OF SENIORITY : Seniority and the employment relationship shall terminate when an employee:
1. Quits.
2. Is discharged for just cause.
3. Is terminated by reason of a total discontinuation of operations.
4. Fails to report at the end of an approved leave of absence.
5. Fails to accept a recall while on layoff.
6. Is laid off for a continuous period of six (6) months.
7. Fails to return to work following the expiration of a medical leave.
