ARTICLE 8 - HOURS OF WORK

Section 1. The Employers shall have the unlimited discretion of establishing the shifts, including the hours covered by such shifts, which are available to drivers working for an Employer subject to this Agreement. However, the hours of any shift shall not be less than nine (9) hours and may not exceed twelve (12) hours.

Section 2. No driver shall be required to work more hours than the hours of his shift (except to complete a trip), excluding charters.

Section 3. During the course of any shift longer than eight (8) hours, the driver shall have the option of taking a lunch break consisting of thirty (30) minutes and two (2) additional breaks of fifteen (15) minutes each.

Section 4. Drivers shall report to work within fifteen (15) minutes prior to the beginning of their shift time, to perform those duties preparatory to the start of their shift. The parties acknowledge that, despite both parties’ best effort, drivers are sometimes required to wait up to forty-five (45) minutes after they report to work to begin their shift. If the driver is required to wait more than one hour for a replacement cab, or his cab is inoperable as a result of mechanical failure, he shall be “Off the book” for that shift. “Off the book” shall be defined as not included in the shift performance average.
