THIS AGREEMENT is entered into by and between ABC Union Cab Company, Inc., Ace Cab, Inc., Vegas-Western Cab, Inc., and A-N.L.V. Cab Company, hereinafter collectively referred to as the Employers, and the United Steelworkers of America, AFL-CIO-CLC, hereinafter referred to as the Union. The Employers and the Union, in the mutual interests of the Employers and their employees, enter into this Agreement with the objectives of promoting the efficiency, economy and profitability of operations, of providing orderly collective bargaining relations, and uninterrupted service to the public, including a method for the prompt, peaceful and equitable disposition of grievances, and the establishment of wages, hours and working conditions of the employees covered by this Agreement.
SUCCESSORS - This Agreement shall be binding upon a Successor to an Employee covered by this Agreement, where the Successor and said Employer are owned by the same person or persons. Should one or more of the Employer(s) signatory to this Agreement via sale, merger, termination of operations, reorganization or other means acquire one or more of the other Employer(s) signatory to this Agreement, then in such event this Agreement shall apply to the Employer or New Employer established.
Should the Employer(s) reorganize the Company(s) under another name(s), this Agreement shall continue to apply to the newly reorganized Employer(s).
If any sale, merger, termination of operations, reorganization and/or other acquisition is made of an Employer signatory to his Agreement, as a result of which the Employer is taken over by any party other than another Employer signatory to this Agreement or other than the same person or persons currently owning that Employer, these successor provisions shall have no effect, and the new Employer shall not be bound by this Agreement.
NOW, THEREFORE, in consideration of the foregoing, the execution of this Agreement and the full and faithful performance of the covenants, representations and warranties contained herein, it is mutually agreed as follows:
Section 1.The Employers recognize the Union as the exclusive representative for purposes of collective bargaining of all full-time and regular part-time taxicab drivers employed by the Employers in accordance with the certification issued by the National Labor Relations Board in Cases 28-RC-4659 and 28-RC-466l.
Section 2.Whenever the words “driver” or “drivers” are used in this Agreement, they designate only such drivers as are covered by this Agreement.
Section 3.The recognition of the Union as the exclusive representative for drivers in this unit applies to drivers known as taxicab drivers and not any other employees of the Employers.
